Rajasthan High Court Decision On Ban, stay in Rajasthan Teachers Eligibility Test (RTET) Concessional Certificates to SC ST OBC PH

The Rajasthan High Court has lifted the ban placed on issue of TET Certificates to the candidates who have been given special concession by the state govt by amending exam guidelines issued by NCTE. The court has observed that the single bench was not having jurisdiction to hear and pass any order on a writ petition challenging any guidelines issued under the Teachers' Eligibility Test (TET) Act as it has a statutory force.
 It was challanged before single judge bench of Rajasthan High Court by petitioners Mahendra and Vigyan Shah that the NCTE has fixed 60% as minimum qualifying marks for all the candidates but the state government has relaxed the minimum qualifying marks by giving 20% relaxation to physically handicapped, 15% relaxation to women, 10% to divorcee and deserted woman and 10% relaxation to SC, ST and OBC male candidates for which the state government was not authorized. It was only for the Central government and NCTE to fix the norms which could not have been altered by the state government," The Govt moved to  the court to vacate the stay granted by the single judge and stay was vacated.
